Terms of Service

1. Agreement to Terms

By accessing or using the Futuranaut Creative Agency website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services

Futuranaut Creative Agency provides social media management, content creation, paid advertising management, and consulting services for small-to-medium businesses.

Service Scope

  • Services are provided as described in our service agreements
  • Deliverables and timelines are outlined in individual contracts
  • We reserve the right to refuse service to anyone for any reason

3. Payment Terms

Pricing

All prices are listed in USD and are subject to change with 30 days notice for existing clients.

Payment Schedule

  • Monthly retainer services are billed in advance
  • One-time consulting services require 50% deposit upfront
  • Late payments may result in service suspension

Refunds

Refunds are handled on a case-by-case basis. Work already completed is non-refundable.

4. Client Responsibilities

Clients agree to:

  • Provide timely access to necessary accounts, assets, and information
  • Respond to approval requests within agreed timelines
  • Provide accurate information about their business
  • Comply with platform terms of service (Facebook, Instagram, TikTok, etc.)

5. Intellectual Property

Client Content

Clients retain ownership of their brand assets, logos, and proprietary information.

Created Content

Upon full payment, clients receive full rights to content created for their accounts. Futuranaut retains the right to use work in our portfolio and marketing materials.

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of business.

7. Cancellation Policy

  • Either party may cancel monthly retainer services with 30 days written notice
  • Clients remain responsible for payment through the end of the notice period
  • No refunds for partial months of service

8. Limitation of Liability

Futuranaut Creative Agency shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or data
  • Platform policy violations by third parties
  • Changes to social media platform algorithms or policies

Our total liability shall not exceed the amount paid by the client in the preceding 12 months.

9. Results Disclaimer

While we strive for excellent results, we cannot guarantee specific outcomes such as follower growth, engagement rates, or sales conversions. Social media results depend on many factors outside our control.

10. Third-Party Services

We may use third-party tools and platforms to deliver our services. Clients must comply with the terms of service of these platforms (Facebook, Instagram, TikTok, LinkedIn, etc.).

11. Modifications to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by the laws of the State of California, United States.
